A Spanish woman was dismissed from her job for consistently arriving at work too early, prompting her to file a lawsuit against the company.
Her contract required her to begin work at 7:30 a.m., but she regularly reached the office between 6:45 and 7:00 a.m. and started working before other employees. Her boss viewed this as a violation of workplace rules and said it created an unnecessary disturbance in the office routine.
In 2023, the employer formally warned her to stop coming so early and to follow the schedule mentioned in her contract. However, she ignored the warning and continued arriving ahead of time. Earlier this year, the owner decided to dismiss her for serious misconduct, stating that her early arrival meant she often had no tasks to perform and was not contributing effectively to the company.
The employee disagreed with the decision and filed an appeal with the Social Court of Alicante, arguing that she was only being punctual and dedicated to her work. After reviewing the case, the court ruled in favor of the employer. It stated that the woman repeatedly ignored clear instructions from her boss, and her behavior affected the trust and professional relationship between them. The court explained that the early arrivals, despite repeated warnings, showed a lack of compliance and respect for workplace rules.
According to the ruling, this conduct was serious enough to justify her termination. The decision has sparked discussion about workplace discipline, with the court emphasizing that even actions that seem positive, such as arriving early, can become problematic if they disrupt the system or go against employer instructions.
