BUDAPEST – The Hungarian Parliament recently unveiled revisions to the nation’s immigration laws, affecting the prospective foreigners who intend to work in the country.
These amendments which would become effective from January 1, 2024 are designed to bolster existing regulations and will have a substantial impact on both foreigners and the processing of ongoing applications.
Under the updated laws, the government is introducing two distinct employment permit categories. The first, labeled the ‘Skilled Workers Permit’, will grant eligible skilled applicants permission to reside in the country for a period of up to three years.
In contrast, the ‘Guest Workers Permit’ will impose limitations on the duration of stay for eligible individuals, excluding the possibility of pursuing permanent residency or sponsoring family members. Moreover, the number of guest workers allowed will be subject to the job positions available in Hungary. Notably, Hungarian sponsoring companies will be required to undertake a resident labor market test for applicants seeking this permit.
To facilitate the implementation of these changes, Hungarian authorities have outlined a plan announcing suspension of the application processing. As per the official announcement, from January 1, 2024, to February 29, 2024, immigration application processing will be temporarily halted, and no fresh employment permit requests will be entertained during this period.
Applications submitted before January 1, 2024, will undergo review after February 29, 2024. Additionally, work permit applications submitted electronically and fully paid before December 31, 2023, will be evaluated based on the existing regulations.
It has also been announced that the residence permits set to expire within this timeframe will be automatically extended until April 30, 2024. The authorities will recommence accepting new applications beginning March 1, 2024.
During this period, a suspension will be in place for new applications for residence permits, residence cards, and EU registration cards and only applications of national significance, explicitly directed by the government, will be considered and accepted.
